Terms of Service
These Terms of Service explain the rules for using the CLWHost website, client area, game server hosting services, support system, and related services.
CLWHost is a trading name operated by a sole trader. In these Terms, “CLWHost”, “we”, “us”, and “our” refer to the person operating CLWHost as a sole trader.
By accessing our website, creating an account, placing an order, using our services, or contacting support, you agree to these Terms of Service. If you do not agree with these Terms, you must not use our website or services.
1. Definitions
In these Terms:
Website means the CLWHost website and client area.
Services means the game server hosting services, support services, and related services provided by CLWHost.
Customer, you, and your mean the person or business using our website or services.
Account means your CLWHost client account.
Server means any game server, hosting service, or related service provided to you by CLWHost.
2. Our Services
CLWHost provides game server hosting services, including hosting for games such as Minecraft Java, Minecraft Bedrock, modded Minecraft, and other supported game titles.
We may add, remove, update, or change available services, plans, features, locations, pricing, or specifications from time to time.
We aim to provide reliable services, but we do not guarantee that any service will be uninterrupted, error-free, or available at all times.
3. Account Registration and Security
You must provide accurate and up-to-date information when creating an account or placing an order.
You are responsible for keeping your login details, passwords, email account, control panel access, and any related credentials secure.
You must contact us as soon as possible if you believe your account or service has been accessed without permission.
We are not responsible for losses caused by your failure to keep your account or credentials secure.
4. Orders, Payments, and Renewals
All services must be paid for in advance unless we agree otherwise.
Invoices are usually generated before the service renewal date. You are responsible for ensuring invoices are paid on time.
If an invoice is not paid by the due date, your service may be suspended, restricted, or terminated.
Late payments may result in a late fee where permitted.
We may refuse, cancel, or reject an order if we believe the order is fraudulent, abusive, high risk, unsuitable, or likely to breach these Terms.
We may refuse renewal of a service at our discretion, including where there has been abuse, repeated payment issues, chargebacks, high-risk activity, or breach of these Terms.
5. Subscriptions and Cancellations
You can request cancellation of a service through the client area.
If you pay using a recurring payment method such as PayPal subscription or automatic payment, you are responsible for cancelling the recurring payment with the payment provider where required.
Cancelling a service with CLWHost may not automatically cancel a third-party recurring payment.
If an overpayment is made by mistake, please contact support and we will review it.
Service cancellation does not remove your responsibility to pay any outstanding invoices, fees, or charges already due.
6. Refunds
New game server hosting orders may be eligible for a refund within 48 hours of the original order being activated, unless excluded by these Terms.
Refunds are not guaranteed and may be refused where:
- The service has been used for abuse, illegal activity, fraud, spam, attacks, or malicious activity.
- The customer has breached these Terms.
- The request relates to a renewal rather than a new order.
- The issue was caused by customer configuration, mods, plugins, files, custom software, or misuse.
- The customer has raised a payment dispute or chargeback instead of contacting support first.
- The service has already been delivered and used for a significant part of the billing period.
- The refund request is outside the stated refund window.
Where consumer cancellation rights apply by law, nothing in these Terms removes your legal rights.
If you ask us to begin providing a service immediately, you acknowledge that the service may begin before any cancellation period ends. If you later cancel where a legal cancellation right applies, you may still be responsible for paying for the service already provided.
Free trials, promotional credit, account credit, add-ons, upgrades, custom work, dedicated resources, special orders, and discounted services may be non-refundable unless required by law.
Refunds are normally returned to the original payment method where possible.
7. Chargebacks and Payment Disputes
If you have a billing issue, you should contact CLWHost support first so we can investigate and try to resolve it.
Raising a chargeback, payment dispute, or payment reversal may result in temporary suspension of your account and services while the issue is investigated.
Where a chargeback or payment dispute is found to be invalid, abusive, or fraudulent, we may terminate services, close the account, refuse future orders, and recover any costs or fees we incur.
8. Service Suspension and Termination
We may suspend, restrict, or terminate your account or services if:
- You fail to pay invoices on time.
- You breach these Terms.
- You use the service for abuse, illegal activity, malicious activity, or prohibited content.
- Your service causes harm, risk, instability, disruption, or security issues.
- You abuse staff, customers, systems, support channels, or third-party services.
- We are required to do so by law, regulation, court order, payment provider, upstream provider, or infrastructure provider.
- Your service presents a security, fraud, network, or operational risk.
Suspension or termination may result in loss of access to your server, files, backups, data, or account.
Refunds are not guaranteed where a service is suspended or terminated due to breach of these Terms.
9. Acceptable Use
You must not use CLWHost services for:
- Illegal activity.
- Malware, viruses, botnets, or malicious software.
- DDoS attacks, stress testing, booting, scanning, or network abuse.
- Spam, phishing, scams, fraud, or impersonation.
- Copyright infringement or unauthorised distribution of protected content.
- Hate, harassment, threats, or targeted abuse.
- Child sexual abuse material or any content involving exploitation of minors.
- Hosting, storing, linking to, or distributing prohibited or harmful content.
- Attempts to gain unauthorised access to systems, accounts, networks, or data.
- Any activity that disrupts or harms CLWHost, our customers, our providers, or third parties.
We may investigate suspected abuse and take action without prior notice where necessary.
10. Game Servers, Mods, Plugins, and Customer Content
You are responsible for the content, files, worlds, mods, plugins, datapacks, scripts, configuration, and software you upload, install, or run on your server.
You must ensure you have the right to use any content you upload or install.
Mods, plugins, custom jars, modpacks, and third-party software may cause crashes, lag, data corruption, incompatibility, security issues, or increased resource usage.
CLWHost may offer general support and guidance, but we are not responsible for problems caused by third-party mods, plugins, software, custom files, or customer configuration.
We may refuse to support, remove, disable, or request removal of content that is abusive, illegal, harmful, insecure, or causing service disruption.
11. Resource Usage and Fair Use
You agree to use services fairly and reasonably.
Your service must not cause excessive CPU, memory, disk, network, storage, I/O, or other resource usage that negatively affects CLWHost, other customers, or service stability.
Unlimited features, where offered, are subject to fair use, technical limits, storage availability, abuse prevention, and reasonable service operation.
We may contact you, limit, suspend, migrate, or terminate a service if it causes excessive load, instability, abuse reports, network issues, or harm to other customers or infrastructure.
12. Backups and Data Loss
CLWHost may provide backup features for some services, but backups are not guaranteed unless expressly stated in your service plan.
Shared game server services may include backup slots or backup options depending on the plan and panel configuration.
Backups may fail, become corrupted, be unavailable, or be affected by technical issues outside our control.
You are responsible for keeping your own important backups of worlds, files, configurations, and other data.
CLWHost is not responsible for loss of data, files, worlds, backups, profits, business, or opportunities arising from service issues, customer error, third-party software, abuse, suspension, termination, hardware failure, or other events.
We may access backups or server files where reasonably necessary for support, migration, restoration, abuse investigation, or security.
13. Support
Support is provided through our available support channels, which may include tickets, email, Discord, or other methods.
We aim to respond as quickly as possible, but response times are not guaranteed.
Discord may be used for quick help and general support, but account-specific issues may need to be handled through tickets for security reasons.
Repeated tickets, duplicate requests, aggressive behaviour, or abuse of support channels may delay support or result in restricted support access.
We may refuse support where a customer is abusive, threatening, repeatedly unreasonable, or asking us to assist with prohibited activity.
14. Abuse, Threats, and Staff Conduct
We operate a zero-tolerance approach to serious abuse.
You must not harass, threaten, abuse, intimidate, discriminate against, or attempt to harm CLWHost staff, customers, community members, or third parties.
This includes abuse through tickets, Discord, email, reviews, social media, chargeback notes, or any other platform.
Abuse may result in warnings, support restrictions, suspension, termination, refusal of future service, or legal action.
15. Service Availability and Maintenance
We aim to keep services available and stable, but downtime may occur.
Downtime may be caused by maintenance, updates, hardware issues, software issues, upstream provider issues, attacks, network issues, third-party failures, emergency work, or events outside our control.
Where possible, we will provide notice of scheduled maintenance, but urgent or emergency maintenance may happen without notice.
We do not guarantee uninterrupted uptime unless a specific written service level agreement applies.
16. IP Addresses, Locations, and Infrastructure
Any IP addresses, ports, server locations, hardware, nodes, or infrastructure assigned to a service remain under the control of CLWHost or our providers.
We may change, move, replace, or reassign infrastructure where necessary for maintenance, security, performance, availability, abuse prevention, provider changes, or operational reasons.
We will try to minimise disruption where possible.
17. Privacy and Data Protection
We process personal information in accordance with our Privacy Policy.
Our Privacy Policy explains what personal information we collect, how we use it, and your data protection rights.
You can view our Privacy Policy here: https://www.clwhost.com/privacy-policy.php
18. Third-Party Services
Our website or services may include links to, integrations with, or use of third-party services, including payment providers, Discord, game panels, infrastructure providers, DNS providers, analytics tools, and game-related services.
We are not responsible for third-party websites, services, software, policies, outages, content, security, or actions.
Your use of third-party services may be subject to their own terms and privacy policies.
19. Intellectual Property
The CLWHost website, branding, text, graphics, logos, layout, and other materials are owned by or licensed to CLWHost unless otherwise stated.
You may not copy, reproduce, modify, distribute, mirror, or use our materials without permission, except for normal personal use of the website and services.
You retain ownership of content you upload to your server, subject to the rights needed for us to provide, manage, secure, back up, migrate, and support the service.
20. Limitation of Liability
Nothing in these Terms limits or excludes liability where it would be unlawful to do so.
To the fullest extent permitted by law, CLWHost is not liable for indirect losses, loss of profits, loss of business, loss of revenue, loss of opportunity, loss of reputation, loss of data, loss of worlds, loss of files, service interruption, or losses caused by customer configuration, third-party software, mods, plugins, providers, attacks, or events outside our reasonable control.
Our total liability for any claim relating to a service will not exceed the amount you paid for that specific affected service during the billing period in which the issue occurred, unless the law requires otherwise.
21. Changes to Services, Pricing, and Terms
We may update services, pricing, features, specifications, policies, or these Terms from time to time.
If we make important changes, we will try to provide reasonable notice where practical.
Continued use of our website or services after changes are made means you accept the updated Terms.
22. Force Majeure
CLWHost is not responsible for failure or delay in performing obligations caused by events outside our reasonable control.
This may include natural disasters, war, terrorism, civil unrest, pandemics, power failures, internet outages, network failures, cyberattacks, supplier failure, provider issues, government action, legal restrictions, or other events beyond our control.
23. Governing Law
These Terms are governed by the laws of England and Wales.
If a dispute cannot be resolved through support, the courts of England and Wales will have jurisdiction, subject to any consumer rights that may apply by law.
